This page/document states the “Terms and Conditions” to be followed so as to use RecruitmentFactory.com, an employment web portal for job posting and employment opportunities and candidate resumes.
By using RecruitmentFactory.com, you are agreeing to abide by the “Terms and Conditions” of use, including our privacy statement. If you do not accept the Terms and Conditions stated here, do not use the website or any of the services it offers. These “Terms and Conditions” may be reviewed and updated by RecruitmentFactory™ at any time. All changes made to this “Terms and Conditions” will be binding on you hence make it convenient to visit this page periodically to keep posted on the same. The term “User” represents all end users of RecruitmentFactory™ and this “Terms and Conditions” is applicable for both employers and job seekers.
RecruitmentFactory™ will act as a passive medium for distributing the user content to its members both candidates and employees. RecruitmentFactory™ will not be held responsible for any of the user content published in RecruitmentFactory™. However, RecruitmentFactory™ may review and delete any user content that, in the sole judgment of RecruitmentFactory™, violates the “Terms and Conditions” or applicable law, rule or regulation, or is offensive or illegal or violates the rights of, harms or threatens the safety of others. RecruitmentFactory™ reserves the right to deny access to Users and prevent their further access to the RecruitmentFactory™. RecruitmentFactory™ may take any action with respect to inappropriate User Content.
Eligibility
The eligibility to access RecruitmentFactory™ is your acceptance of our “Terms and Conditions”. By visiting RecruitmentFactory™ you warrant that you accept the terms and conditions stated here and that you have the right, authority and capacity to agree to and abide by these “Terms and Conditions” of use. You also warrant that you will not use RecruitmentFactory™ in any manner inconsistent with any applicable laws and regulations.
Use of information
The content or information available in RecruitmentFactory™ can be accessed for your personal use. All content used in RecruitmentFactory™ or any other websites under the control of RecruitmentFactory™ such as text, graphics, images, logos, button icons, software and other Content are protected under copyright, trademark and other laws. You agree not to sell or modify the Content or reproduce, display, publicly perform, distribute, or otherwise use the Content in any way for any public or commercial purpose online or in print. This “Terms and Conditions” also prevents you from copying the HTML / JavaScript or CSS or any other components of RecruitmentFactory.com to generate similar pages for commercial purpose.
User Restrictions
You agree not to use RecruitmentFactory™ to distribute or store anything in violation of any applicable law or regulation. Content that is offensive in nature such as obscene, vulgar, sexually-oriented, hateful, defamatory, threatening, or otherwise in violation of any laws, should not be stored or distributed in RecruitmentFactory™
Users are not allowed to store or distribute anything that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others.
Users may not violate or attempt to violate the security of RecruitmentFactory™ by accessing data not intended for users or by logging in to a server or account which the user is not authorized to access.
Users shall not probe, scan or test the vulnerability of RecruitmentFactory™ system or network or breach security or the authentication measure without proper authorization.
Users shall not interfere with service to any user, host or network, including by means of injecting virus programs or malicious scripts, overloading, flooding, spamming, forging TCP/IP packet header or any other harmful methods not mentioned here.
Such violations of system or network security may result in civil or criminal liability. RecruitmentFactory™ will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
Specific Prohibited Uses
The job advertising, job listing and resume database search of RecruitmentFactory™ and other value added services may be used only for lawful Purpose by candidates seeking employment and employers seeking candidates.
RecruitmentFactory™ specifically prohibits any other use of RecruitmentFactory™, and all Users agree not to do any of the following:
- You may not post jobs on RecruitmentFactory™ for any competitor or post any content that links to any of RecruitmentFactory™ competitor websites;
- You may not post any content that contain email address, HTML Tags or content intended to create harm or misleading information;
- You may not use RecruitmentFactory™‘ Resume Database for any purpose other than as an employer seeking employees. You may not use RecruitmentFactory™ Resume Database to sell Candidate information or promote any products or services;
- You may not post any incomplete, false or inaccurate information in RecruitmentFactory™
- You may not post any information you have no right in or any information that violates the law or regulation of any kind.
- You may not post any jobs that require an up front or periodic payment or that requires recruitment of other members, sub-distributors or sub-agents;
- You may not send unsolicited e-mails or mails or phone calls or faxes regarding promotions and/or advertising of products or services to a user of RecruitmentFactory™
- You may not revise or alter any information provided by another RecruitmentFactory™ user.
- You may not take any action that may affect the security of RecruitmentFactory™ using softwares or any others means.
- You may not attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of RecruitmentFactory™
- You may not aggregate, copy or duplicate in any manner any of the RecruitmentFactory™ content or information available from RecruitmentFactory™
Registration
In order to register with RecruitmentFactory™, you will be asked to provide certain information such as your email address, personal details and your professional / educational details etc. By registering with RecruitmentFactory™, you understand and agree that RecruitmentFactory™ may disclose your information to third parties, however RecruitmentFactory™ will not disclose to any third party your name, address, email or any other sensitive information without your prior consent, except to the extent necessary or applicable to comply any applicable law or regulation or in legal proceedings where such information is relevant.
You are responsible for maintaining the confidentiality of your account details including the username and password. You shall be responsible for any user who logs in to RecruitmentFactory™ with your username and password. Do not disclose your username and password to anyone. If you think your account has been accessed by someone with your permission, you must notify RecruitmentFactory™ immediately. Protect your personal information by never providing credit card, bank account numbers or any other personal information open to misuse to prospective employers.
RecruitmentFactory™ reserves the right to provide services and products to you based on your preferences you opted in your registration and at any time thereafter. These products or services can be made by RecruitmentFactory™ or any third parties. RecruitmentFactory™ does not make any representation as to the quality or nature of any of the third party products or service purchased through RecruitmentFactory™.
Account Information
You are solely responsible for your account information, resumes, content, messages or any information used in RecruitmentFactory™. By posting any content to RecruitmentFactory™ you warrant that you have the right to grant RecruitmentFactory™ the complete right to use, copy, perform, display and distribute your information. You also warrant that the content or information you post in RecruitmentFactory™ doesn’t violate any copyright, trademark, or any other law and regulation.
The following is a partial list of User Content that is prohibited in RecruitmentFactory™. While there are very few specific prohibited User Content list, please use common sense.
- User Content implicitly or explicitly offensive, such as content that endorses or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual is prohibited in RecruitmentFactory™
- User Content that harasses or incites harassment of any group or individual
- User Content that involves the transmission of spamming
- User Content that promotes or endorses misleading information or illegal activities or conduct
- User Content that is abusive, threatening, obscene, defamatory or libelous
- User Content that promotes or endorses an illegal or unauthorized copy of another person's copyrighted work, such as pirated computer programs or devices or pirated music or other media or links to such unauthorized data
- User Content that contains restricted web pages, or hidden pages or images
- User Content that displays or links to pornographic, indecent or sexually explicit material of any kind
- User Content that provides or links to material that exploits people under the age of 18 in a sexual, violent or other manner
- User Content that solicits personal information from anyone under 18
- User Content that provides instructional information about illegal activities or other activities prohibited such as making or buying illegal weapons, violating someone's privacy, or spreading computer viruses or pirating any media
- User Content that solicits passwords or personal identifying information from other Users
RecruitmentFactory™’s Liability
RecruitmentFactory™ will act as a passive medium for employers to advertise their jobs or to find suitable candidates and candidates to post resumes and find employment. RecruitmentFactory™ does not screen or censor any information posted by either party. RecruitmentFactory™ is not involved in any transaction between employers and candidates, and hence RecruitmentFactory™ has no control over the quality, safety or legality of the information posted by employers or job seekers.
RecruitmentFactory™ will not be held responsible for any harm of dealing with strangers, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through RecruitmentFactory™. The information posted by other people can be offensive, harmful or inaccurate to you and in some cases can be deceptive. Please use caution and common sense while using RecruitmentFactory™
Since user authentication on the internet is difficult RecruitmentFactory™ cannot confirm that each User is who they claim to be. In the event you have a dispute with one or more Users, you release RecruitmentFactory™ from claims, demands and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
RecruitmentFactory™ makes no representations about the accuracy, reliability or completeness or timeliness of any content or functionality of the application. The use of RecruitmentFactory™ is at your own risk. RecruitmentFactory™ undergoes changes periodically and such changes may be made without any notice.
Candidates are solely responsible for the form, content and accuracy of any resume or material contained therein placed by them on RecruitmentFactory™. Employers are solely responsible for their job postings on RecruitmentFactory™.
RecruitmentFactory™ shall not be responsible for any employment decisions, for whatever reason made by any entity posting jobs on RecruitmentFactory™
RecruitmentFactory™ cannot guarantee and does not promise any specific result from RecruitmentFactory™. No advice or information, oral or written, obtained by any user from RecruitmentFactory™ shall create any warranty not expressly stated here.
Limitation of Liability
RecruitmentFactory™‘s maximum liability in any case, regardless of the cause of action (Whether in contract, tort, breach of warranty or otherwise) will not exceed $ 250
Disclaimer of Warranty
RecruitmentFactory™ does not warrant that RecruitmentFactory™ operates error-free or RecruitmentFactory™ or its products or services it offers are free of any harmful mechanisms such as malicious programs or computer viruses. RecruitmentFactory™ cannot be held responsible for any kind of loss to your computer hardware or software or data caused by using RecruitmentFactory™ .
RecruitmentFactory™ makes no warranty about the accuracy, reliability, completeness or timeliness of the information, products and services provided in RecruitmentFactory™
Disclaimer of Consequential Damages
RecruitmentFactory™ in no event shall be responsible for any damages including incidental and consequential, lost profits or damages caused to you resulting from the use or inability to use any of the product, service or information provided in RecruitmentFactory™
Links to Other Sites
RecruitmentFactory™ contains links to third party websites. These links and the content are provided solely as a convenience to you and not as an endorsement by RecruitmentFactory™ on such third party websites. RecruitmentFactory™ is not responsible for the content of linked third party sites and does not make any representations regarding the content or accuracy of materials on such third party websites. If you decide to access linked third party websites, you do so at your own risk.
Resale or Unauthorized Commercial Use
You understand and agree that you can not resell or assign your rights or obligations under these terms and conditions. You also agree not to make any unauthorized commercial use of RecruitmentFactory™ without the express written consent of recruitmentfactory.com.
Indemnity
You agree to defend , indemnify and hold harmless the RecruitmentFactory™ and their respective officers, directors, employees and agents from and against any claims, actions or demands including legal and accounting fees, alleging or resulting from any User Content or other material you provided to RecruitmentFactory™ or your use of RecruitmentFactory™ or your breach of the terms and Conditions. RecruitmentFactory™ shall provide notice to you promptly of any such claims, suit or proceedings.
General
RecruitmentFactory™ makes no claims that the RecruitmentFactory™ Content may be lawfully viewed or accessed outside the United States of America. Access to the RecruitmentFactory™ content may not be legal by certain persons or in certain countries. If you access RecruitmentFactory™ from outside of the United States, You do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan. The Courts in the State of Michigan shall have the exclusive jurisdiction to decide upon any dispute or litigation between the parties to this Agreement, and the parties hereby agree to be subject to the personal jurisdiction of the Courts in the State of Michigan.
If any provision of these “Terms and Conditions” is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these “Terms and Conditions”, which shall remain in full force and effect. No waiver of any term of these “Terms and Conditions” shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in an additional agreement, additional terms of use for areas of RecruitmentFactory™, and a particular "Legal Notice," or Software License or material on particular Web pages, these “Terms and Conditions” constitute the entire agreement between You and the Company with respect to the use of RecruitmentFactory™. No changes to these “Terms and Conditions” shall be made except by a revised posting on this page.
Termination
RecruitmentFactory™ reserves the right at its sole discretion to terminate the membership of a user with out any prior notice. RecruitmentFactory™ also reserves the right to pursue all of its legal remedies, including permanently denying access to RecruitmentFactory™ or any of its partner web services.
These terms and Conditions will remain intact while you are a RecruitmentFactory™ member. You are bound by certain provisions of these “Terms and Conditions” even after your termination.
We value our user’s feedback on the product and service we offer them. We request you to be specific in your comments regarding our service. However none of the feedback shall be subject to any obligation, except to the extent specifically requested by RecruitmentFactory™
